 Constitutionality Decision

Holding that A.R.S.§ 15-108(A) (2012), which added to the list of locations where possession or use of medical marijuana is prohibited under the Arizona Medical Marijuana Act (Proposition 203 (2010), codified in A.R.S. §§ 36-2801 through -2819), violates the Voter Protection Act, Ariz. Const. art. 4, pt. 1, § 1(6)(C), and is unconstitutional as applied to AMMA-compliant marijuana possession or use.

Constitutionality Decision

Holding that applying Arizona Rule of Juvenile Procedure 64(C) in pretrial proceedings does not conflict with A.R.S.  § 8-863(C) in violation of the separation of powers required by the Arizona Constitution, article 3.

PLEASE NOTE:  On August 19, 2016, an Order was filed correcting the following sentences:

The second sentence of ¶ 2 of the opinion is amended to read as follows: The policies failed to list certain covenants, conditions, and restrictions (“CC&R's”) that allegedly prohibited commercial development on either parcel.

The first sentence of ¶ 18 of the opinion is amended to read as follows: In any event, the title defect in this case is not an undisclosed lien, but is instead undisclosed CC&R's that allegedly prevented the borrowers/owners from developing the property, which in turn allegedly caused them to default on their loans.
